2. SCOPE OF THESE TERMS

These Terms of Service apply to your use of our website and to all orders placed through it. By accessing the website or placing an order, you agree to these Terms.

If you are buying as a consumer, nothing in these Terms affects any rights you have under applicable law that cannot lawfully be excluded or limited.

3. PRODUCTS

We sell made-to-order wall murals, wallpaper murals, samples and related items.

All products are subject to availability. Product images, room scenes, previews and mock-ups are for illustrative purposes only. Colours, scale and finish may vary slightly between on-screen display and the final printed product due to monitor settings, lighting conditions, production methods and material characteristics.

Because many of our products are made to order, small variations between batches may occur.

4. MEASUREMENTS, WALL SUITABILITY AND CUSTOMER INPUT

You are responsible for checking that your wall measurements, delivery address and order details are accurate before submitting your order.

Where stated on the website, we recommend adding a trimming allowance to your measurements before ordering. If you choose a crop, composition, size, material or other configuration, your order will be produced in accordance with those selections.

Our murals are generally best suited to smooth or lightly textured, clean and well-prepared walls. If you are unsure about compatibility, surface preparation, colour or finish, we recommend ordering a sample before placing a full order.

We are not responsible for installation errors, unsuitable wall conditions, incorrect measurements, incorrect surface preparation or damage caused by improper installation, except where the issue is caused by a product fault or where mandatory law provides otherwise.

5. SAMPLES

Samples are intended as an aid to assess colour, finish and material before purchase. Samples may not fully replicate the scale of a full mural and may not show the complete artwork.

A sample may also differ slightly from a later full order due to print batch, material batch, scale and production factors.

6. PRICES, CURRENCIES, TAXES AND CHARGES

Product prices are displayed in the relevant storefront or market currency where available.

Shipping charges and any other non-optional charges shown by us will be displayed before you complete checkout.

Where applicable, taxes, sales tax, VAT, import duties, customs clearance charges, tariffs or carrier handling fees may be calculated at checkout or may be payable separately upon import or delivery.

Unless expressly stated otherwise at checkout, any import duties, taxes, customs clearance charges, tariffs or carrier handling fees arising in the destination country are your responsibility.

We may change prices at any time, but price changes will not affect an order that has already been accepted.

7. HOW ORDERS ARE FORMED

The website is intended for orders placed in the English language.

Before you submit an order, the website allows you to review your selections and correct input errors. Placing an order is an offer to buy.

After we receive your order, we will normally send an acknowledgement of receipt by electronic means. That acknowledgement does not by itself mean that your order has been accepted.

Your order is accepted only when we send you an order confirmation or otherwise begin processing your order for production, whichever happens first.

We may keep a record of the contract and order details for our internal records. You should save or print a copy of these Terms and your order confirmation for future reference.

We reserve the right to decline, suspend or cancel an order before acceptance, for example where:

  • there is an obvious pricing or product description error;
  • the product or material becomes unavailable;
  • we reasonably suspect fraud, misuse or unauthorised activity;
  • the information you supplied is incomplete or incorrect; or
  • we cannot deliver to the address or destination provided.

If we cancel an order after payment but before acceptance, we will refund the amount paid for the cancelled order.

8. PRODUCTION, SHIPPING AND DELIVERY

We currently accept orders for delivery to the United Kingdom and the United States.

Most products are made to order. Any production times, dispatch times or delivery windows shown on the website, at checkout or in order communications are estimates only unless we expressly agree otherwise in writing.

If we cannot ship within the timeframe we stated to you, or where a shipment deadline applies under mandatory law, we will notify you and, where required, offer you the option to wait for a revised shipment date or cancel the unshipped order for an appropriate refund.

We are not responsible for delay caused by events outside our reasonable control, including courier disruption, customs processing, severe weather, supply interruption, strikes, systems failure or force majeure events.

Where tracking information is provided, you are responsible for monitoring delivery updates and ensuring that someone is available to receive the parcel where required.

9. CANCELLATION RIGHTS AND MADE-TO-ORDER GOODS

If you purchase an item that is not made to your specifications and is not clearly personalised, you may have a legal right to cancel within the applicable cancellation period under consumer law.

However, most of our murals and custom-sized wallcoverings are made to your specifications or are clearly personalised. Once production has started, change-of-mind cancellation or return is generally not available for those products, except where mandatory law provides otherwise.

If you need to amend or cancel an order, please contact us as soon as possible at contact@aurennestudio.com.

If production has not yet started, we may be able to help. Once production or fulfilment has begun, cancellation may no longer be possible.

10. FAULTY, DAMAGED OR INCORRECT ITEMS

Nothing in these Terms affects your rights if goods arrive faulty, damaged, incorrect, unsafe or not as described.

If there is a problem with your order, contact us as soon as reasonably possible and preferably within 7 days of delivery at contact@aurennestudio.com, including:

  • your order number;
  • a short description of the issue; and
  • clear photographs of the product and packaging where relevant.

Where appropriate, we may offer a replacement, repair, partial refund, full refund or other remedy required by applicable law.

Please do not install or apply a product that you believe may be faulty, damaged or incorrect without first contacting us, as installation may make it harder to assess the issue.

11. RETURNS AND REFUNDS

Do not send any item to our business address or to any address shown on packaging unless we have given you written return instructions.

Where a return is approved, refunds will be issued to the original payment method.

If law permits, we may wait until returned goods are received or satisfactory evidence of return is provided before issuing a refund.

We may refuse a return or reduce a refund to the extent permitted by law where returned goods have been handled beyond what is reasonably necessary to inspect them, or where the return does not comply with these Terms or our Return and Refund Policy.

12. INTELLECTUAL PROPERTY AND WEBSITE USE

All content on this website, including text, layouts, graphics, photographs, artwork, previews, branding, logos and design assets, is owned by us or licensed to us and is protected by intellectual property laws.

You may use the website for personal, lawful and non-commercial purposes only.

You must not copy, reproduce, republish, distribute, modify, create derivative works from, scrape, reverse engineer or commercially exploit any part of the website or its content without our prior written consent.

You must not use the website in a way that is unlawful, harmful, misleading, fraudulent or that may damage, disable or interfere with the website or our business.

13. OUR LIABILITY

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot lawfully be excluded.

If you are a consumer, we are responsible for foreseeable loss and damage caused by our breach of these Terms or our negligence. We are not responsible for loss or damage that was not foreseeable.

If you use our products for any business, trade or commercial purpose, we are not responsible for business losses, including loss of profit, loss of business, business interruption, loss of opportunity, loss of goodwill, loss of data or anticipated savings.

If you are a business customer, to the fullest extent permitted by law we exclude any liability for indirect, special, incidental or consequential loss.

These limitations apply only to the extent permitted by applicable law.

14. PRIVACY AND COOKIES

Your use of the website is also governed by our Privacy Policy and Cookie Policy.

By using the website, you acknowledge that personal data may be processed in accordance with those policies.

15. EVENTS OUTSIDE OUR CONTROL

We are not liable for any failure or delay in performing our obligations where that failure or delay results from events outside our reasonable control.

Events outside our reasonable control may include courier disruption, customs delays, severe weather, natural disasters, strikes, labour disputes, supply chain interruption, production disruption, technical failures, cyber incidents, governmental action, war, civil unrest or other force majeure events.

16. COMPLAINTS AND CONSUMER DISPUTE INFORMATION

If you have a complaint about an order, product, delivery or refund, please contact us first at contact@aurennestudio.com.

We will try to resolve the issue with you directly.

Information about the Portuguese Electronic Complaints Book, also known as Livro de Reclamações, and, where applicable, consumer alternative dispute resolution information, is made available through the relevant links in our website footer.

Nothing in this section prevents you from using any rights or remedies available to you under applicable law.

17. GOVERNING LAW AND JURISDICTION

These Terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of Portugal, except that mandatory consumer protection laws in your country or state of residence may still apply if you are entitled to rely on them.

If you are a consumer, you may bring proceedings in the courts that are competent under applicable law.

If you are a business customer, the Portuguese courts shall have exclusive jurisdiction, unless mandatory law requires otherwise.
